本法第37條規定:「勞工與雇主間關於工資之爭執,經證明勞工本於勞動關係自雇主所受領之給付,推定為勞工因工作而獲得之報酬。」因此若雇主給予勞工任何給付,不作任何規範及聲明保留,若發生爭執進入訴訟,都會被推定為勞工工資,影響所及,勞工得請求之加班費、資遣費、退休金、預告工資、特休未休工資甚至職災補償數額都會因此增加。為避免發生當事人預期以外之法律效果,建議勞動契約及工作規則對於工資及工資以外給付妥為約定,雇主在給予勞工各項給付時,於工資明細及工資清冊亦應記載清楚
